PROPOSED CONSENT ORDER

MARSHALL COUNTY
Pursuant to the provisions of the Alabama Environmental Management Act, § 22-22A-1 et seq., Code of Alabama 1975, as amended, and Act No. 2003-397, the Alabama Department of Environmental Management is proposing to issue a Consent Order to Alabama Farmer’s Cooperative Inc., the owner/operator of a feed production facility in Guntersville, Alabama.
The violations consisted of failing to apply for an Air Permit prior to commencing construction of air emission sources.
The Department is proposing a civil penalty in the amount of $10,000.00. The order, if issued, would require Alabama Farmer’s Cooperative to comply with the terms, limitations, and conditions of the Department’s regulations.
Interested persons may submit written comments, including request for a hearing, within 30 days of the publication date of this notice, to:

Persons wishing to comment may do so, in writing, to the Department’s named contact above within 30 days following the publication date of this notice. All comments must be received in the ADEM Main Office in Montgomery no later than 5:00 p.m. CST on the last day of the comment period.
