Polyplex USA, LLC, NPDES Permit Number AL0082210, located at 3001 Mallard Fox Drive North West, Decatur, Alabama 35601, for re- issuance of existing discharges resulting from stormwater runoff associated with polyethylene terephthalate products manufacturing discharging through Outfalls DSN001 and DSN003 into an Unnamed Tributary of the Tennessee River, classified as Fish & Wildlife in the Tennessee River Basin; stormwater runoff associated with polyethylene terephthalate products manufacturing and diesel fueling and storage areas discharging through Outfall DSN002 into an Unnamed Tributary of the Tennessee River, classified as Fish & Wildlife in the Tennessee River Basin.

Marigold Works, LLC, NPDES Permit Number AL0083721, located at 200 18th Avenue SW, Jasper, Alabama, 35501, address same as physical location, for initial issuance of existing discharges resulting from equipment washdown and stormwater associated with heavy equipment manufacturing, discharging through Outfall DSN001, into Tanyard Creek; discharges resulting from Stormwater associated with heavy equipment manufacturing, discharging through Outfalls DSN002, DSN003, and DSN004, into Tanyard Creek. Tanyard Creek at these locations is classified as Fish and Wildlife and is in the Black Warrior River Basin.

Drummond Company, Inc. - Short Creek Preparation Plant, Post Office Box 1549, Jasper, Alabama 35502, NPDES Permit Number AL0043711, located on Short Creek Road, Mulga, Jefferson County, Alabama, for reissuance of a permit that limit discharges from a wet and dry coal preparation plant and associated areas, discharging to Locust Fork and an unnamed tributary to Locust Fork, classified as Fish and Wildlife, in the Black Warrior Basin.

Jesse Creek Mining, LLC - Kodiak Mine, 1615 Kent Dairy Road, Alabaster, Alabama 35007, NPDES Permit Number AL0069108, located at 3400 County Road 260, Montevallo, Shelby County, Alabama, for modification of a permit that limits discharges of treated drainage from a dry preparation coal mining operation and associated areas, discharging to Piney Woods Creek and unnamed tributaries to Piney Woods Creek, classified as Fish and Wildlife, in the Cahaba River Basin.

Jackson Water Works and Sewer Board, Post Office Box 1096, Jackson, Alabama 36545, NPDES Permit Number AL0052922, for re-issuance of a permit which limits the discharge of pollutants from filter backwash from Jackson Water Treatment Plant, 2751 Commerce Street, Jackson, Alabama 36545, for the purpose of meeting Federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to the Tombigbee River, classified as Public Water Supply, Swimming, and Fish & Wildlife, in the Tombigbee River Basin.

Cullman County

Cullman Utilities Board, Post Office Box 278, Cullman, Alabama 35056, NPDES Permit Number AL0082091, for re-issuance of a permit which limits the discharge of pollutants from filter backwash from Cullman Filter Plant, 1740 3rd Street SE, Cullman, Alabama 35056, for the purpose of meeting federal and state water quality regulatory standards.  The subject permit regulates the discharge of treated wastewater to an Unnamed Tributary to Eightmile Creek, classified as Fish & Wildlife, in the Black Warrior River Basin.

The Department has tentatively determined that the proposed actions described in this notice are consistent with the Water Quality Program regulations; and for those in the coastal area, are consistent with the Alabama Coastal Management Program.

Copies of the draft permits, conditions, limitations and a fact sheet as applicable describing the methodology for setting the limitations and conditions and other applicable NPDES forms and related documents are available for public inspection electronically via http://www.adem.alabama.gov/newsEvents/PublicNotices.cnt, and at the following location Monday – Friday (except legal holidays), 8:00 am to 5:00 pm.  A nominal fee for copying and/or mailing may be charged.  Arrangements for copying should be made in advance.

Persons wishing to comment may do so, in writing, to the Department's named contact above within 30 days following the publication date of this notice.  COMMENTERS SHOULD IDENTIFY THE APPROPRIATE NPDES NUMBER ON THE FIRST PAGE OF THEIR COMMENTS.  In order to affect final decisions, comments must offer technically substantial information that is applicable to the proposed permit.

A written request for a public hearing may also be filed within that 30-day period and must state the nature of the issues proposed to be raised in the hearing.  The Director shall hold a public hearing whenever it is found, on the basis of hearing requests, that there exists a significant degree of public interest in the permit application or draft permit.  The Director may also hold a hearing if he determines that it would clarify one or more issues involved in the permit decision.

After consideration of all written comments, review of any public hearing record, and consideration of the requirements of the Alabama Water Pollution Control Act, the Federal Water Pollution Control Act and applicable regulations, the Department will make a final determination.  The Department will develop a response to comments, which will become part of the public record and will be available to persons upon request.  Notice will be sent to any person requesting notice of the final action.
