Pursuant to the provisions of the Alabama Environmental Management Act, the Alabama Department of Environmental Management is proposing to issue an Order to the Alabama State Port Authority (ASPA), Mobile County, Mobile, Alabama. ASPA has been issued an Alabama Hazardous Wastes Management and Minimization Act (AHWMMA) post closure permit for corrective action of contaminated soils, surface water, and groundwater at the former Alabama Wood Treating Corporation which is on land now owned by ASPA. ASPA has been assigned EPA ID Number ALD058221326.

The violations consist of: (1) ASPA’s failure to install five piezometers for over six years after they were required by the facility’s AHWMMA permit, (2) ASPA’s failure to notify the Department of non-compliance with their AHWMMA permit for the six year period, and (3) ASPA’s failure to submit to the Department two reports (an Annual Groundwater Assessment Report since 2008, and a Semi-Annual Report of the Effectiveness of Corrective Actions since 2004) required by their AHWMMA permit.

The Department is proposing a civil penalty in the amount of $8,400. ASPA shall be required to: (1) install the five piezometers required by their AHWMMA permit, (2) provide to the Department all Annual Groundwater Quality Assessment Reports and Semi-Annual Reports of the Effectiveness of Corrective Action in accordance with the schedules in ASPA’s AHWMMA permit, (3) report permit non-compliance as required in their AHWMMA permit, and (4) pay to the Department a civil penalty in the amount of $8,400.
